Terms of Service

You must be at least 18 years old and able to form a binding contract under Arizona law to use the Service. By using Pop's, you represent that you meet these requirements.

Pop's helps pop-up, market, and fair vendors estimate event costs, calculate a break-even revenue target, and log actual results after an event. Pop's offers a free tier (one event cycle at a time) and a one-time paid unlock (unlimited events, event history, CSV import, and event-type recommendations).

Pop's is a planning and tracking tool. It does not provide financial, accounting, tax, or legal advice, and it does not guarantee that any event will be profitable. All break-even calculations and recommendations are based solely on the information you enter and are provided for informational purposes only. You are responsible for verifying your own numbers before making business decisions.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@popspopups.com if you suspect unauthorized access.

The free tier requires no payment information. The paid unlock is a one-time fee, charged once and processed securely through Stripe. We do not store your full payment card details. Prices are as displayed at the time of purchase and may change for future purchases without affecting unlocks already purchased.

If you purchase the paid unlock and are not satisfied, you may request a full refund within 7 days of your purchase date by emailing support@popspopups.com. Refunds are limited to one per customer. After a refund, your account reverts to the free tier. We reserve the right to deny a refund request that appears to be part of a repeated pattern of purchase-and-refund activity.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or scrape the Service
• Resell, sublicense, or share paid access with others outside your own use
• Interfere with the Service's operation or security

You retain ownership of the event, expense, and business information you enter into Pop's ("Your Data"). By using the Service, you grant us a limited license to store, process, and display Your Data solely to operate and improve the Service for you. We do not sell Your Data. You are solely responsible for the accuracy of the information you enter. Pop's performs calculations based on that information; it does not independently verify it.

The Pop's name, logo, design, software, and all related materials are the property of AP Creations LLC. Nothing in these Terms grants you any ownership or license in our intellectual property beyond the right to use the Service as intended.

Pop's relies on third-party providers, including Stripe (payment processing) and our hosting and infrastructure providers, to operate. We are not responsible for outages, errors, or issues caused by these third parties.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY BREAK-EVEN CALCULATION OR RECOMMENDATION WILL BE ACCURATE OR RESULT IN PROFITABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AP CREATIONS LLC'S TOTAL LIABILITY ARISING FROM YOUR USE OF THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR LOST BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Pop's is one product of AP Creations LLC. If you engage with another AP Creations LLC product or service, including The Unexpected Studio, that separate engagement is governed by its own terms and policies, not these Terms.

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service and request account deletion at any time by emailing support@popspopups.com.

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Arizona.
